VOIS Terms of Use
The agreement between you and Amazing K (Pty) Ltd t/a VOIS | Effective date: 12 June 2026
1. About these terms
These Terms of Use are an agreement between you and Amazing K (Pty) Ltd (registration number 2013/066820/07), a registered special-needs centre based in South Africa ("Amazing K", "we", "us", "our"), and govern your use of the VOIS application and website (together, "VOIS"). By creating an account or using VOIS, you agree to these terms. If you do not agree, please do not use VOIS.
You must be 18 years or older to create a VOIS account. VOIS is set up and managed by adults — parents, family members, therapists, and educators — on behalf of the children and adults who use it to communicate.
2. What VOIS is — and what it is not
VOIS is a communication aid and educational tool. It helps people who are non-verbal, pre-verbal, or have limited speech to communicate using pictures, words, and recorded voices.
VOIS is not a medical device, and it is not a substitute for professional speech therapy, assessment, diagnosis, or treatment. We make no claims or promises about therapeutic results from using VOIS. The clinical tools available to Professional accounts (session logs, goals, and analytics) are record-keeping aids for the convenience of therapists; they are not a certified clinical records system and do not constitute formal medical or clinical records. Section 8 explains this in more detail.
3. Your account
- You are responsible for keeping your login details confidential and for all activity that takes place under your account.
- One account may manage more than one child profile, up to the limit of your plan (see Section 5).
- If you use a Professional account, you are responsible for ensuring that only authorised staff have access to the account, and that they handle the children's information appropriately.
- Please tell us promptly if you believe your account has been accessed without your permission.
4. Acceptable use
When using VOIS, you agree that you will:
- use it only as a communication aid, for its intended purpose;
- obtain appropriate consent before photographing any person, and especially before photographing a child;
- not upload content that is illegal, harmful, abusive, or inappropriate;
- not attempt to access another user's account or data;
- not store or share sensitive personal information beyond what is needed to build a communication board; and
- not copy, extract, resell, or reverse-engineer the VOIS app, its code, or its icon library.
5. Plans, payments, and licences
VOIS offers several plans:
- Personal — a single communication profile, paid once-off;
- Family — up to three profiles, paid once-off;
- Family Plus — up to five profiles, paid once-off;
- Professional — unlimited profiles for schools, clinics, and therapy centres, paid monthly.
Your licence is tied to your account, not to a particular device — you can sign in on more than one device. Payments are processed by our payment provider, Payfast; we do not store your full card details. Refunds and cancellations work as follows. If you are an individual who buys a once-off plan (Personal, Family, or Family Plus) directly from us, you have a cooling-off period of seven days from the date of purchase, during which you may cancel for any reason and receive a full refund; we will process that refund within 30 days of your cancellation, in line with the Electronic Communications and Transactions Act. After the seven-day period, once-off purchases are non-refundable, except where the law requires otherwise — for example, if VOIS does not work as described.
Professional accounts are paid monthly and may be cancelled at any time: cancellation stops future billing and your access continues until the end of the current paid month, but fees already paid for that month are not refunded. Where you buy VOIS through an app store, that store's refund policy applies to your purchase. None of this affects your statutory rights under South African consumer law.
We may change our prices from time to time; any change will apply to future purchases or renewals, and we will let you know in advance where the law requires it.
6. Who owns what
The VOIS application, its branding, design, code, and icon library belong to Amazing K. The icon library is licensed for use only within VOIS and may not be extracted or used elsewhere.
You keep ownership of the content you create — your photographs, voice recordings, and board configurations. By using VOIS, you give us a limited licence to store and process that content for the sole purpose of providing the service to you. Voice recordings are the exception: they are stored only on your own device and are never uploaded to us, as explained in our Privacy Policy. We do not claim ownership of your content, and we do not use it for any purpose other than running VOIS for you.
7. Your content and your responsibility
You are responsible for the photographs and voice recordings you add to VOIS, including for obtaining consent from anyone who appears in a photograph. We do not view, moderate, or analyse the content you create. If you would prefer not to use photographs, VOIS includes a built-in icon library you can use instead.
8. Clinical tools (Professional accounts)
The clinical tools available to Professional accounts — session logging, goal tracking, observation tags, and analytics — are provided as a convenience to help therapists track their work. They are not a certified clinical records system. You should not rely on them as your sole record of the therapy you provide.
Therapists and institutions remain responsible for keeping their own formal clinical records in line with the requirements of their professional bodies (for example, the HPCSA and SASLHA). Any analytics or reports VOIS produces are simply summaries of the information you have entered; they are not clinical assessments or recommendations, and we are not responsible for clinical decisions made using them. Where VOIS is used by a school, clinic, or therapy centre, the Data Processing Agreement described in Section 9 also applies.
9. Professional accounts and the Data Processing Agreement
When VOIS is used by a school, clinic, or therapy centre, that institution is the responsible party under POPIA for the children's and clinical information its staff enter, and VOIS acts as its operator. A separate Data Processing Agreement between VOIS and the institution governs that relationship and applies in addition to these terms. Our Privacy Policy explains this split in more detail.
10. Privacy
Our Privacy Policy explains what information we collect, how we use and protect it, and the rights you have under POPIA. By using VOIS, you also agree to the Privacy Policy, which forms part of these terms.
11. Availability of the service
We work hard to keep VOIS running well, but we provide it on an "as is" and "as available" basis. We may update, change, or remove features, and there may be times when the service is unavailable for maintenance or for reasons beyond our control. We do not guarantee that VOIS will always be available or error-free.
12. Limitation of liability
To the fullest extent allowed by law, Amazing K is not liable for any loss of data, communication difficulties, therapeutic outcomes, or decisions made using the clinical tools. We are not liable for events beyond our reasonable control, such as internet or hosting outages (a force majeure event).
Where we are found liable despite this, our total liability to you is limited to the fees you have paid us for VOIS.
13. Suspending or ending your account
You may delete your account at any time. When you do, we permanently delete your information in line with our Privacy Policy. We may suspend or end your access to VOIS if you breach these terms. For Professional accounts, the handling of records when an account ends is dealt with in the Data Processing Agreement.
14. Changes to these terms
We may update these terms from time to time. When we do, we will show you a notice in the app, and the effective date at the top will change. If the changes are significant, we may ask you to read and accept the updated terms before continuing to use VOIS.
15. Governing law
These terms are governed by the laws of the Republic of South Africa, and any dispute will be subject to the jurisdiction of the South African courts.
